TERMS & CONDITIONS

1. CONCEPTS

1.1. Purchase and Sale Rules - these are the Terms and Conditions of the distance Purchase and Sale Contract, which set out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the goods and payment for them, the procedure for the delivery of the goods and the return of the goods, the liability of the parties, as well as any other provisions relating to the purchase of goods in the www.nextlevel2life.com online shop.
1.2. E-shop - the Electronic Store located on the www.nextlevel2life.com website, where the Buyer, whether or not registered with the electronic store system, can purchase the goods offered by the Seller.
1.3. Seller - NEXT LEVEL 2 LIFE, Aurelijus Stulpinaitis individual activity certificate No. 1216011, activity carried out in accordance with the laws of the Republic of Lithuania, E-shop address www.nextlevel2life.com.
1.4. Buyer - a person who meets the requirements set out in Clause 2.2. of these Terms and Conditions of Purchase and Sale and who has purchased goods in the E-shop.
1.5. The Contract of Purchase and Sale between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for the goods in the E-shop, completes all the steps of the order, the last of which is the selection and confirmation of the method of payment, after having read and understood the present Rules.

2. GENERAL CONDITIONS

2.1. By this Purchase and Sale Contract, the Seller undertakes to sell and deliver the Goods to the Buyer, and the Buyer undertakes to accept the Goods and to pay the sum of money specified for the Goods and the delivery charges, if any, on the terms and conditions set out in this Contract.
2.2. The right to make purchases in the E-shop is available to registered and non-registered customers who are:
2.2.1. able-bodied natural persons, i.e. persons over 18 years of age whose legal capacity has not been restricted by a court order;
2.2.2. minors aged between 14 and 18, only with the consent of their parents or guardians, unless they have their own income;
2.2.3. legal persons;
2.2.4. authorised representatives of all the above.
2.3. The E-shop is operated from the Republic of Lithuania.
2.4. The Buyer can order goods at any time of the day or night.
2.5. Together with the Buyer's order for the Goods, these Terms and Conditions of Purchase and Sale shall become a contract of Purchase and Sale between the Buyer and the Seller and shall be a binding legal document on both parties.
2.6. The Buyer shall not be entitled to place an order for goods in the E-shop if the Buyer is not familiar with and/or does not agree to the Terms and Conditions of Purchase and Sale. In cases where the Buyer does not agree with the Terms and Conditions of Purchase and Sale or a part thereof, the Buyer shall not be able to place an order in the E-shop. Otherwise, if the Buyer has placed an order, the Buyer shall be deemed to have read and accepted the Terms and Conditions of Purchase and Sale.
2.7. The Seller does not assume any risk or responsibility and is unconditionally released from any responsibility if the Buyer has not fully or partially familiarized himself with the Purchase and Sale Rules, although he was given such an opportunity.

3. BUYER'S RIGHTS

3.1. The Buyer shall have the right to purchase goods in the E-shop in accordance with the procedures set out in these E-shop Terms and Conditions of Purchase and Sale.
3.2. The Buyer shall have the right to withdraw from the Contract of Purchase and Sale of Goods concluded in the E-shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the Goods to the Buyer, in accordance with the procedure set out in the Civil Code and the present Rules of Purchase and Sale of Goods, except where the Goods have been produced in accordance with the Special Instructions.
3.3. The Buyer may only exercise the Buyer's right referred to in Clause 3.2 if the Goods have not been damaged or substantially changed its appearance or if it has not been used.

4. BUYER'S OBLIGATIONS

4.1. The buyer, who has placed an order in the E-shop, must pay for the purchased goods and accept them in accordance with the procedure established by these Purchase and Sale rules.
4.2. The Buyer is fully responsible for the actions performed in the E-shop www.nextlevel2life.com.
4.3. The Buyer is responsible for the accuracy, correctness, completeness and timely correction of the data provided in the registration form in the event of any changes. In no case will the Seller be responsible for damages caused to the Buyer and/or third parties if the Buyer provides inaccurate, incorrect, incomplete data in the registration form, or does not immediately correct the changed personal data.
4.4. The Buyer is responsible for the transmission of his/her login data to third parties. If a third party uses the services provided by the E-shop by using the Buyer's login data to log in to the E-shop, the Seller considers this person as the Buyer.
4.5. By using the services of the E-shop, the Buyer undertakes to comply with these Rules of the Purchase and Sale, other terms and conditions clearly indicated in the E-shop and not to violate the laws of the Republic of Lithuania.

5. SELLER'S RIGHTS

5.1. If the Buyer attempts to damage the stability and security of the E-shop or violates the obligations specified in Clause 4 of the Rules of Purchase and Sale, the Seller has the right to restrict or suspend the Buyer's access to the E-shop or to terminate the Buyer's registration immediately without notice and is not responsible for any related losses of the Buyer.
5.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements of the law. The Buyer will be informed of any changes to the Terms and Conditions on the website of the E-shop or by the e-mail address indicated. The Buyer shall be subject to the Terms and Conditions in force at the time of placing the order when making purchases in the E-shop.
5.3. The Seller has the right to temporarily or permanently discontinue the operation of the E-shop without prior notice to the Buyer.
5.4. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer fails to pay for the Goods within 3 (three) working days.
5.5. The Seller has other rights set out in these Terms and Conditions and the legal acts of the Republic of Lithuania.

6. SELLER'S OBLIGATIONS

6.1. The Seller undertakes to enable the Buyer to use the services provided by the E-shop under the Rules set out in these Terms and Conditions of Purchase and Sale.
6.2. The Seller undertakes to deliver the Goods purchased by the Buyer to the Buyer in accordance with the Terms and Conditions set out in these Terms and Conditions of Purchase and Sale.
6.3. If the Seller is unable to deliver the Goods ordered by the Buyer, the Seller undertakes to offer the Buyer an analogous or, as far as possible, similar Goods. If the Buyer refuses to accept an analogous or, as far as possible, similar product, the Seller undertakes to refund the money paid by the Buyer for such goods within 14 (fourteen) working days from the date of delivery, if the Buyer has made a prepayment for the Goods. In this case, the Seller is released from responsibility for non-delivery of the Goods.
6.4. The Seller may not refund the amount paid by the Buyer until the Goods have been returned to the Seller.

7. CONCLUSION OF THE PURCHASE AND SALE CONTRACT

7.1. The Buyer may purchase Goods in the E-shop www.nextlevel2life.com in accordance with the Rules set out on this website.
7.2. The Contract of Purchase and Sale between the Buyer and the Seller is considered to be concluded when the Buyer forms and submits an order for the Goods in the E-shop, completes all the steps of the order, the last of which is the selection and confirmation of the method of payment, after having read and understood the present Rules.
7.3. Each Contract of Purchase and Sale concluded between the Buyer and the Seller is registered and stored in the E-shop database.

8. PRICES OF GOODS, ORDERING AND PAYMENT OF GOODS

8.1. The prices of the Goods in the E-Shop are indicated in euros. Prices include VAT. After confirmation of the order, a delivery fee, if applicable, is added to the total amount of the goods.
8.2. After visiting the E-shop, the Buyer familiarise themselves with the Purchase and Sale Rules, chooses the items he likes and puts them in his shopping cart. After creating the shopping cart, the Buyer enters the personal data necessary to fulfill the Order: his/her name, surname, the address to where the Goods will be delivered, telephone number and any additional information that may be important for the delivery of the Goods ordered. By submitting an order, the Buyer confirms that have read and accepted Purchase and Sale Rules.
8.3. The Buyer can make payment for the Goods in one of the following ways:
8.3.1. Visa, Mastercard, American Express bank cards. If you choose to pay by card, you will need to enter your bank card details. A credit card is not required for this payment method, it is sufficient that the payment card is marked "Secure online payment" in your online banking.
8.3.2. Payment via online banking Swedbank, SEB, Luminor, Citadele, Šiaulių Bankas, Urbo, LKU, Paysera, Revolut, Wise, N26.
8.3.3. Payment via PayPal.
8.3.4. Payment via Apple Pay.
8.4. The Buyer, having chosen the payment method referred to in Clauses 8.3.1, 8.3.2, 8.3.3, 8.3.4 in the E-shop, undertakes to prepay for the Goods.
8.5. In the E-shop, payments are processed using the stripe.com, opay.eu and paypal.com payment platforms. Payments can be made in Euro currency.

9. PROMOTIONS APPLIED BY THE SELLER

9.1. The Seller has the right to organise and run various promotions, such as price reductions, bundles, discounts, at his own discretion.
9.2. The Seller has the right to unilaterally and without prior notice change the duration, terms and conditions of promotions or cancel them. Any change or cancellation of the terms and conditions of promotions is valid only from the moment of their execution and does not apply to orders placed before them. Information about ongoing promotions is available on the E-shop website.
9.3. The Seller has the right to sell gift cards/coupons for which the Buyer can purchase goods sold by the Seller. No discounts are applicable to gift cards/coupons purchased. Gift cards/coupons cannot be exchanged for cash.
9.4. When the Buyer pays with a gift card/coupon for the purchased goods with a value lower than the value of the gift card/coupon, the difference in price is not refunded to the Buyer. When the Buyer pays with a gift card/coupon for the purchased goods, the value of which is higher than the value of the gift card/coupon, he must pay the difference in price to the Seller.
9.5. Discount codes with a specific amount of money apply to no more than half the value of the item.
9.6. Discounts are not available on sale items. The Seller has the right to unilaterally determine other types of goods to which discounts do not apply.
9.7. Only one discount code or gift card/coupon may be used per purchase.
9.8. Gift cards/coupons and cash discounts are not exchangeable for cash.
9.9. If the price of the ordered Goods changes, the price valid at the time of the order will be applied to the Buyer.
9.10. In some cases, the Seller may apply the promotional price to a maximum of 3 (three) items of the same name ordered by the Buyer in one order, for which the Seller applies the promotional price at the time of ordering.

10. DELIVERY OF GOODS

10.1. Goods ordered by the Buyer in the E-shop are delivered by courier services or by post to the specified address. If the courier or post office provides such a service, the parcel may be redirected to a parcel locker of the Buyer's choice, in which case the Buyer will be informed about this by the courier's or post office SMS message and/or email. The Buyer must specify the exact delivery address and other contact information when ordering the Goods.
10.2. Goods are delivered within the territory of the Republic of Lithuania except for the Curonian Spit, and also delivered to Europe, the USA, the UK, the EFTA countries (Iceland, Liechtenstein, Norway, Switzerland), Canada, Australia, New Zealand, Japan, Brazil and the rest of the world.
10.3. All orders are shipped from our fulfilment centres in Europe (UK, Spain, Latvia), USA and Canada. Shipments are fully tracked - from us to your door (you will receive an email with a tracking number when your shipment is ready and dispatched).
10.4. The processing of orders takes 2-5 business days before they are dispatched. Please note that the standard delivery time does not include these processing days.
10.5. Standard delivery times to Europe, USA, UK, EFTA countries (Iceland, Liechtenstein, Norway, Switzerland), Canada, Australia, New Zealand, Japan and Brazil are 2-7 working days, while the rest of the world can take 8-21 working days. *These standart delivery times are approximate and not guaranteed. Orders are produced and shipped from the fulfillment centre closest to the customer. If the product ordered is not available at the nearest fulfilment centre to the customer, then it will be manufactured and dispatched from the next nearest fulfilment centre, in which case delivery times may differ from the standard delivery times stated. The delivery cost is calculated in the final checkout window.

10.7. In some cases an additional customs and tax fee can occur depending on the destination country. The fee may vary depending on your order value, country limits, and other factors based on the product itself. Customer is responsible for these fees. Any fees are paid to appropriate customs agency by the end customer.
10.8. The Buyer undertakes to accept the Goods himself. When accepting the Goods, a valid proof of identity is required. If the Buyer is unable to accept the Goods himself and the Goods have been delivered to the address specified by the Buyer, the Buyer has no right to complain to the Seller about the delivery of the Goods to the wrong person.
10.9. Goods are delivered by the Seller or his authorised representative.
10.10. In all cases, the Seller is released from responsibility for the violation of the terms of delivery of the Goods, if this violation was not caused by circumstances beyond the Seller's control.
10.11. If the Goods are not delivered due to the Buyer's fault or due to circumstances caused by the Buyer (e.g. the Buyer has incorrectly indicated the place of delivery, or the Buyer cannot be found), the Goods will not be resent, unless the Buyer requests resending, for which an additional fee will apply.
10.12. At the time of delivery of the Goods, the Buyer must check the condition of the packaging, the quantity, quality and range of the Goods together with a representative of the transport/courier company that delivered the Goods.
10.13. If damage of the package is detected, the Buyer must note the damage of the package on the data logger or in the paper delivery confirmation provided by the representative of the transport/courier company.
10.14. In the event of any discrepancy(s) in the quantity and/or quality and/or range of the Goods, the Buyer must not accept the shipment. In this case, the Buyer, together with a representative of the transport/courier company, shall draw up a free-form document in which the violations are noted.
10.15. If the Buyer does not write a free-form shipment damage report in accordance with the procedure set out above, the Seller is exempted from responsibility towards the Buyer for any damage to the Goods, if such damage was caused by packaging damage.
10.16. Once the Buyer has signed the invoice (waybill) or any other document indicating the delivery and acceptance of the Shipment, it is considered that the Shipment has been delivered, is in proper condition and that there are no claims against the Seller.
10.17. The risk of accidental damage to the Goods passes to the Buyer from the moment the Goods are handed over to the Buyer.

11. RETURNS

11.1. In all cases of returning goods, before returning the goods, the Buyer must first of all contact the Seller via the contact details provided in the E-shop and inform the Seller by e-mail: info@nextlevel2life.com, describing the problem with the returnable goods. The email must include the Buyer's name, address, all possible contact details (telephone, mobile, email), order number, date of purchase and receipt of shipment, amount paid, name of the product, and the reasons for the return/exchange. If the product(s) is (are) defective, a detailed description of the defects found must be provided. When returning the goods, it is necessary to provide a document confirming the purchase of the goods.
11.2. In order to return the product(s), the Buyer can do so within 14 (fourteen) days from the date of delivery of the goods to the Buyer, by informing the Seller by email, attaching photos or videos of the product and/or parcel describing the problem.
11.3. If the returned item is of poor quality or defective, the Buyer must provide the Seller with photos or videos of the damaged item and/or parcel by email.
11.4. If it is established that the product was damaged due to the fault of the Buyer, the money for the product is not refunded, in this case the product will be returned to the Buyer only after payment of the costs of return and re-shipment.
11.5. The Buyer does not have the right to return the purchased goods if he or she is not satisfied with the colour, shape, size or design of the goods.
11.6. Returning costs for returning quality or replacement goods are paid by the Buyer.
11.7. The Buyer can only use the right to return the goods if the time limit for returning the goods has not been missed, the goods have not been damaged or their appearance has not been substantially changed, and the goods have not been used and are in the same condition as when the Buyer received them, without any loss of commercial appearance. All returned goods must be with their original labels intact, with their protective films intact, their protective bags intact and their original packaging, undamaged, unused, in the same set as the Buyer received them, without losing their merchandise appearance. When returning the product, Buyer must provide a paper (printed) document of purchase (copy of the order, purchase receipt).
11.8. The Buyer does not have the right to cancel the contract and return the goods if quality goods were manufactured according to the Buyer's special instructions or if they are clearly adapted to the Buyer's (user) specific needs. Some of the goods in our E-shop are manufactured according to the Buyer's special instructions, so these goods can only be returned due to defects or damage caused during transport.
11.9. The goods are your property and responsibility until they reach the Seller, so when returning the goods, please make sure that you have properly packed them and that they will not be damaged during shipping. Fragile goods must be packed in such a way that they can be transported safely. All returned goods will be inspected. The Seller reserves the right not to accept the goods back with signs of mechanical damage if they were caused by the fault of the Buyer.
11.10. When returning the wrong product, the Buyer must inform the Seller immediately, but no later than within 7 (seven) working days. The Seller undertakes to replace such product with the required product. If the required item is not available, all money (for the item and the actual shipping costs incurred) will be returned to the Buyer.
11.11. When a defective product is returned, the Seller undertakes to replace the defective product with a similar product or refund the Buyer.
11.12. In order to return the defective product(s), the Buyer can do so within 14 (fourteen) days from the date of delivery of the goods to the Buyer, by informing the Seller by email, attaching photos or videos of the defective goods and describing the problem.
11.13. The defective product to be returned must be in its original, neat packaging, undamaged, unused, in the same set as the Buyer received it, without losing its merchandise appearance (labels intact, protective film not torn off, etc.). When returning the product, it is necessary to present a paper (printed) document of its purchase.
11.14. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with the return procedure set out in the Rules.
11.15. The Seller has the right not to refund the Buyer until the goods have been returned to the Seller and have been inspected.
11.16. The Buyer must pay for the delivery costs and the return costs and the Seller must reimburse the Buyer for the delivery and return costs incurred by the Buyer if the Seller is convinced that the goods have been returned due to faulty quality.
11.17. Refunds are not available for goods that have been damaged intentionally or negligently (by chemicals, water, open flames, high temperatures, sharp objects, etc.), or if the Rules of Use or Storage of the goods have been violated, or if the goods have been used improperly or for an improper purpose.
11.18. If the Buyer paid for the product with a gift coupon, the coupon and any additional amount paid (if it was paid) will be refunded.
11.19. If the Buyer returns the product purchased with a discount, the amount paid for the product is returned, including the valid discount.
11.20. These Goods Return Rules are drawn up in accordance with the laws and regulations of the Republic of Lithuania.
11.21. These Rules are subject to the law of the Republic of Lithuania. All disagreements arising from the implementation of these Rules are resolved through negotiations. If an agreement cannot be reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
11.22. The Seller is not responsible for the fact that the colour, shape or other parameters of the goods in the E-shop may not correspond to the real size, shape and colour of the goods due to the characteristics of the display used by the Buyer.
11.23. The photos of the products displayed in the E-shop are illustrative and are shown more vividly than in reality. Therefore, please note that the product color, design color, design size and position of the real product may differ slightly from those shown in the photos.

12. PRIVACY POLICY. COLLECTION, USE, CORRECTION AND STORAGE OF PERSONAL DATA

12.1. The Seller or the Personal Data Controller - nextlevel2life.com, established in accordance with the laws of the Republic of Lithuania, Aurelijus Stulpinaitis individual activity certificate No. 1216011, registered address Vyturių g. 1, Kuršėnai, Lithuania, e-mail address: info@nextlevel2life.com (hereinafter - the Seller or the E-shop).
12.2. E-shop - the Seller's Electronic Store at www.nextlevel2life.com.
12.3. Buyer/Customer or Data Subject - a natural person - a Customer of the Store (including website visitors) whose personal data is collected by the Seller.
12.4. Services - all services provided by the Seller.
12.5. Personal Data - any information related to a natural person - a Data Subject, a Buyer/Customer.
12.6. Processing of Personal Data - any action performed with Personal Data: collection, recording, accumulation, storage, classification, grouping, connection, change (addition or correction), provision, publication, use, logical and/or arithmetic operations, search, dissemination , destruction or other action or set of actions.
12.7. Partner - a legal entity that provides services to the Seller related to the Seller's activities, or sells goods to the Seller, or carries out joint projects with the Seller, including, but not limited to, marketing campaigns, joint sales campaigns, loyalty programs, etc., in media, online pages, Electronic store, retail stores, retail chains, etc.
12.8. Direct marketing - is an activity aimed at offering goods or services to individuals by mail, telephone or any other direct means and/or asking for their opinion on the offered goods or services.
12.9. Privacy Policy - means this document, which establishes the principles and rules of processing Personal Data, using the services of the Electronic Store.
12.10. A cookie is a small piece of textual information that is automatically created when browsing the website and is stored on the visitor's computer or other device.
12.11. Account - the main data for the Buyer's/Customer's connection to the Online Shop, which consists of one email address and Password.
12.12. Password - is a unique combination of numbers, letters, or numbers and letters or other symbols created by the Buyer/Customer, which can be used to log in to the E-shop account.
12.13. Personal data is processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing and protection of Personal Data, this Privacy Policy.
12.14. The Buyer/Customer grants the Seller the right to perform all Personal Data processing actions within the scope and purposes provided for in this Privacy Policy.
12.15. Personal Data is processed accurately, fairly and legally. Data is collected for defined and legitimate purposes , Personal Data is constantly updated.
12.16. Personal Data is stored in such a form that the identity of the Data Subject can be determined no longer than is necessary for the purposes for which these data were collected and processed.
12.17. All information about Personal Data is confidential.
12.18. Personal Data and personal information of the Buyer/Customer will not be used for any illegal purposes.
12.19. It is considered that the Buyer/Customer has read the Privacy Policy of the current version and agrees with it when making a purchase in the Electronic Store. If the Buyer/Customer does not agree with any part of the Privacy Policy or the Privacy Policy, in this case the Buyer/Customer must not place an order or purchase the product(s) in the Electronic Store.
12.20. The Privacy Policy can be viewed in the E-shop and can be printed at any time. The Privacy Policy may be changed, supplemented or updated at the discretion of the Seller. The new version of the Privacy Policy is published in the Electronic Store.
12.21. During the initial registration to the Electronic Store, when creating an Account, the Buyer/Customer must provide an e-mail address and a secure Password and must provide accurate Personal Data to the Electronic Store. The Buyer/Customer is responsible for their correctness.
12.22. The Buyer/Customer must not disclose the Password to third parties and must keep it safe, otherwise all related responsibility rests with the Buyer/Customer.
12.23. When using the Services, as well as when making purchases in the Electronic Store, the Buyer/Customer must always provide accurate Personal Data to the Electronic Store and is responsible for their correctness.
12.24. The Buyer/Customer can place an order in the Electronic Store without registration, or through personal Account after registering in the Electronic Store.
12.25. The Buyer/Customer has the right to change and update the Personal Data in the Account at any time or to contact the Electronic Store with a request to cancel the Account.
12.26. The Seller respects every Buyer's/Customer's right to privacy. The Buyer's/Customer's Personal Data (i.e. name, surname, email address, phone number, product/service delivery address, age/year of birth, product/service payment details (bank account number, payment method, etc.), purchase history, and also, with the Buyer's/Customer's consent, age, gender, date of birth, place of residence) are collected and processed for the following purposes:
12.26.1. For the purpose of e-commerce. The following Personal Data is processed: name, surname, email address, phone number, product/service delivery address, age/year of birth, IP address, product/service payment data. The duration of storage of Personal Data used for the purpose of e-commerce is 5 (five) years from the date of the last connection to the Electronic Store.
12.26.2. For direct marketing purposes. The following Personal Data is processed: name, surname, phone number, e-mail address, address, age, gender, date of birth, place of residence. The storage period of Personal Data used for the purpose of Direct Marketing is 5 (five) years from the date of the last connection to the Electronic Store.
12.27. Registration, login and other Buyer/Customer account data is stored as long as the Buyer/Customer account is valid. Upon deletion of the Buyer's/Customer's account, the Buyer's/Customer's identification, contact and other data are permanently destroyed or depersonalised in such a way that the Buyer/Customer cannot be identified. The purchase data is decoupled from the Buyer's/Customer's account and stored for a specified time period.
12.28. The Buyer/Customer can give consent to the processing of his Personal Data (name, surname, phone number, email address, address, age, gender, date of birth, place of residence) for the purpose of Direct Marketing. If, after giving consent to process his Data for the purpose of Direct Marketing, as well as to receive Direct Marketing messages, the Buyer/Customer no longer wishes to do so and informs the Seller, the Seller will no longer process the Buyer's/Customer's Personal Data for the purpose of Direct Marketing and will no longer send the Buyer/Customer any electronic news, except for the information related to the Buyer's/Customer's order.
12.29. The Buyer/Customer has the right at any time to revoke his consent to the Seller processing his Personal Data for the purpose of Direct Marketing, as set out in Clause 12.28., by submitting an appropriate notification to the Seller by e-mail at info@nextlevel2life.com, clearly stating that he revokes his consent to the use of his Personal Data for the purpose of Direct Marketing and that he do not wish to receive any Direct Marketing communications.
12.30. The Buyer/Customer also has the possibility to refuse to exercise his right to object to the processing of the Buyer's/Customer's Personal Data for the purpose of Direct Marketing by clicking on the relevant link in each email sent for marketing purposes.
12.31. The Buyer/Customer, as a Data Subject, has the right to receive from the Seller information about the processing of the Buyer's/Customer's Personal Data, to have access to his Personal Data and to know how it is processed.
12.32. The Buyer/Customer, as a Data Subject, has the right to receive information from the Seller from which sources and what personal data of the Buyer/Customer have been collected, for what purpose they are processed, to which recipients the data are provided and have been provided for at least the last 1 (one) year.
12.33. The Buyer/Customer, as a Data Subject, has the right to request the correction, destruction of the Buyer's/Customer's Personal Data or to suspend, except for the storage, the processing of his Personal Data, when the Personal Data is processed in violation of the Law of Legal Protection of Personal Data of the Republic of Lithuania and the other laws.
12.34. The Buyer/Customer, as a Data Subject, has the right to submit a complaint to the State Data Protection Inspectorate.
12.35. When exercising his rights, the Buyer/Customer must provide a passport, identity card or driving licence. The Seller provides the Data Subject with information about the processing of the Data Subject's Personal Data once a year free of charge. The Buyer/Customer may exercise his rights provided for in Clauses 12.31., 12.32., 12.33., 12.34. by contacting by e-mail at info@nextlevel2life.com. The Seller has the right to correct, modify, delete or suspend the processing of Personal Data only after the identity of the Buyer/Customer who made the request has been identified.
12.36. The Buyer's/Customer's Personal Data is not provided to third parties, except in the following cases:
12.36.1. When the consent of the Buyer/Customer has been obtained, as specified in this Privacy Policy;
12.36.2. Personal data for e-commerce purposes are provided to Partners who provide services to the Seller related to the Seller's activities;
12.36.3. To the competent authorities in the cases provided for by the laws and legal acts of the Republic of Lithuania.
12.36.4. The Electronic Store processes payments using the stripe.com, opay.eu and paypal.com payment platforms, so your personal information necessary for the execution and confirmation of the payment will be provided to the operators of these platforms.
12.37. The Buyer/Customer agrees that his Personal Data will be transferred to the Partners during the execution of the order submitted by the Buyer/Customer in the Electronic Store, as well as when the Seller provides the Services to the Buyer/Customer, as well as to the Seller's Partners, as specified in Clause 12.36.
12.38. The Buyer/Customer is aware of his right not to consent to the processing of his Personal Data for the purpose of Direct Marketing, i.e. the Buyer/Customer has the right to express his disagreement immediately or later.
12.39. If the Buyer/Customer does not agree with the Privacy Policy, the Buyer/Customer will not be able to use the services of the Electronic Store.
12.40. The Seller implements organisational and technical measures to protect Personal Data against accidental or unlawful destruction, alteration, disclosure or any other unlawful processing.
12.41. Upon receiving the Data Subject's instruction or enquiry related to the processing of Personal Data, the Seller provides the Buyer/Customer with an answer, satisfying the request/instruction or refusing to do so with reasons, no later than within 30 (thirty) calendar days from the date of the Data Subject's request.
12.42. In order for the Seller to be able to offer the Buyer/Customer full services in the Electronic Store, with the Buyer's/Customer's consent, information Cookies are recorded on the Buyer's/Customer's computer/device, which are used to identify the Buyer/Customer as a previous user of the Electronic Store, to collect statistics of the Electronic Store's attendance, information about the shopping cart. At any time, the Buyer/Customer can view what Cookies are being saved and can delete part or all of the saved Cookies.

12.44. The Seller has the right to change, amend or supplement the "Privacy Policy" in whole or in part. Additions or changes to the Privacy Policy take effect from the date of their publication.

13. FINAL PROVISIONS

13.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
13.2. These Rules and relations between the Parties in relation to these Rules apply and are interpreted in accordance with the laws of the Republic of Lithuania.
13.3. Any disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
13.4. Communication between the Buyer/Customer and the Seller, including but not limited to messages, correspondence takes place in written form. Notices sent by e-mail are also treated as notices in written form. An e-mail notification is considered received when 96 hours have passed from the moment it was sent.
13.5. The Seller reserves the right to change, amend or supplement the Purchase and Sale Rules at any time, taking into account the requirements established by legal acts. Any amendments, modifications or additions are available to the Buyer/Customer on the Seller's website. By purchasing goods in the Electronic Store, the Buyer/Customer agrees with the changed, corrected, supplemented Purchase and Sale Rules. The Buyer's/Customer's consent is expressed by submitting the Order to the Seller. The possibility to purchase goods in the Electronic Store is provided only to Buyers/Customers who agree to the current Purchase and Sale Rules.
13.6. The copying, distribution and use of any information from the Electronic Store without the written consent of the Seller is prohibited.
13.7. The Parties are released from fulfilling their obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force Major).
